Tobacco Claims Information

A recent decision of the Florida Supreme Court, known as Engle vs. Liggett Group, has approved approved a significant part of the jury verdict in favor of some cigarette smokers and against some manufactures of cigarettes.  The decision says that based on the jury verdict against the tobacco companies, individual lawsuits for damages can be brought against these tobacco companies:

  • Philip Morris, Incorporated

  • Lorillard Tobacco Company

  • Lorillard, Incorporated

  • Brown & Williamson Tobacco Corporation

  • American Tobacco Company

  • R. J. Reynolds Tobacco Company

Smokers who receive the benefit of this jury verdict include persons who suffered from certain smoking related diseases before November 21, 1996, or their surviving spouse or children.

  • Aortic Aneurysm

  • Bladder Cancer

  • Cerebrovascular Disease

  • Cervical Cancer

  • Chronic Obstructive Pulmonary Disease

  • Coronary Heart Disease

  • Esophageal Cancer

  • Kidney Cancer

  • Laryngeal Cancer

  • Lung Cancer (specifically, adenocarinoma, large cell carcinoma, small cell carcinoma, and squamous cell carcinoma)

  • Complications of Pregnancy

  • Oral Cavity/Tongue Cancer

  • Pancreatic Cancer

  • Peripheral Vascular Disease

  • Pharyngeal Cancer

  • Stomach Cancer

Here is a checklist to see if you qualify to benefit from the Engle verdict.

  • Resident of Florida before November 21, 1996

  • U.S. Citizen before November 21, 1996

  • Suffered a listed disease before November 21, 1996

  • Smoked cigarettes

  • The brand smoked was made by: Philip Morris, Inc, Lorillard Tobacco Co., Lorillard, Inc., Brown & Williamson Tobacco Corp., American Tobacco Co., or R. J. Reynolds Tobacco Co.

  • Did not know they were addicted to smoking until after May 1990

  • Knew (or should have known) their disease was caused by smoking after May 1990 if they lived until November 21, 1996

  • Or died after May 1992
